Tax Alert: FTA Approves New VAT Refund Categories for Emirati Homebuilders (June 2026 Update)
Great news for UAE citizens building their own private homes: The Federal Tax Authority (FTA) has officially expanded the list of construction and landscaping expenses eligible for VAT recovery.
Announced on June 9, 2026, this newly revised directive allows Emirati homeowners to reclaim the 5% VAT on a much broader range of property features. Even better, the FTA has made this change retroactive—meaning it applies to all qualifying VAT refund applications submitted on or after January 1, 2026.
What Can You Claim Now?
Historically, lifestyle additions like swimming pools, smart tech, and landscaping were strictly excluded from the VAT refund scheme. Under the new rules, the following 8 categories are now fully eligible:
Outdoors & Landscaping: Swimming pools, outdoor fountains, built-in garden features, and general landscaping works.
Smart Tech & Security: Integrated smart home systems, security networks, and electronic/smart doors for both the main residence and the garage.
Staff Accommodations: Built-in quarters for drivers, watchmen, and domestic workers.
Recreation Rooms: Dedicated home gyms and indoor game rooms.
Indoor Aesthetics: Decorative indoor water features.
Complete Reconstruction: Demolition and rebuilding expenses for full-home reconstruction projects.
The Golden Rules for Eligibility
To successfully recover your VAT on these newly added items, they must meet three strict criteria set by the FTA:
Fixed and Permanent: The items must be built into or permanently attached to the property. Movable items—such as loose furniture, plug-in appliances, standalone smart speakers, and unattached decor—remain strictly ineligible.
Same Plot: The additions must be located on the exact same plot of land as your main private residence.
Personal Use Only: The property must be used exclusively as a private home for you and your family, not for commercial, hospitality, or rental purposes.

Because this rule is backdated to the start of the year, if you submitted a VAT refund application between January 1 and June 9, 2026, and excluded items like your pool or smart home system based on the old rules, you may be entitled to additional tax savings.
